1. Privacy at a Glance

This privacy policy explains the nature, scope, and purpose of the processing of personal data on our websites scmotif.com and docs.scmotif.com.

3. Hosting

Both websites, scmotif.com and our documentation at docs.scmotif.com, are delivered by Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA ("Cloudflare"). Every page request passes through Cloudflare's servers. Cloudflare processes the data your browser sends with each request (see "Server Log Files" in section 5) to deliver the sites and protect them against attacks.

Cloudflare processes this data on our behalf under a data processing agreement, including on servers in the United States. Cloudflare is certified under the EU-US Data Privacy Framework (Art. 45 GDPR); the data processing agreement additionally incorporates the EU standard contractual clauses.

The legal basis is Art. 6 (1) (f) GDPR. We have a legitimate interest in delivering our websites reliably and securely.

4. General Information and Mandatory Disclosures

We take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the applicable data protection regulations and this privacy policy.

We would like to point out that data transmission over the internet (e.g., when communicating by email) may have security gaps. Complete protection of data against access by third parties is not possible.

5. Data Collection on Our Websites

Server Log Files

With every request, your browser automatically sends the following data to the server:

  • Browser type and version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing device
  • Time of the server request
  • IP address

Cloudflare processes this data only to deliver and secure the sites. We have not set up storage of access logs for either website, and we do not merge this data with other data sources. The legal basis is Art. 6 (1) (f) GDPR.

Cookies

The documentation at docs.scmotif.com sets no cookies. scmotif.com only sets cookies with your explicit consent (Art. 6 (1) (a) GDPR). On your first visit, a banner asks whether you consent to the use of analytics cookies. Your decision is stored locally in your browser.

If you consent, Google Analytics cookies are set (see section 6). If you decline, no cookies are set and no data is transmitted to third parties.

You can change or withdraw your decision at any time using the Cookie settings link in the footer of every page. Withdrawing your consent deletes the analytics cookies that were set and stops any further transmission to Google. Your decision itself is stored under the key scmotif_cookie_consent in your browser's Local Storage. This entry is strictly necessary to honour your choice, so it does not itself require consent (§ 25 (2) TDDDG).

External Resources

All fonts and assets are delivered with the websites by our host Cloudflare. Neither website loads content from other servers. Google Analytics is only loaded if you have given your consent via the cookie banner.

6. Google Analytics

scmotif.com uses Google Analytics, a web analytics service provided by Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics is only loaded with your consent (Art. 6 (1) (a) GDPR). Without your consent via the cookie banner, no data is transmitted to Google.

We use Google Analytics 4. IP addresses are used by Google only to derive an approximate location and are not logged or stored by Google Analytics 4. Data may be processed by Google LLC in the USA; Google is certified under the EU-US Data Privacy Framework and additionally relies on the EU standard contractual clauses. Processing by Google is carried out on our behalf on the basis of Google's data processing terms (Google Ads Data Processing Terms).

Event data is retained for two months, user data for 14 months from your last visit.

Google Analytics uses cookies to analyze website usage. The information generated by cookies is usually transmitted to and stored on a Google server.

7. Beta Applications (WorkOS)

Applications for the closed beta are collected on a page hosted by our identity provider WorkOS, Inc., San Francisco, USA. Our website links there without loading any WorkOS code; until you follow that link, no data reaches WorkOS. The application form asks for your email address.

We use the address to review your application, to reply to you personally, and, if we approve the application, to send the invitation through which you register for SCMotif. WorkOS sends you a confirmation when you apply. The legal basis is Art. 6 (1) (b) GDPR (steps taken at your request prior to entering into a contract).

WorkOS processes the address on our behalf, including on servers in the United States. This transfer is safeguarded by a data processing agreement that incorporates the EU standard contractual clauses (Art. 46 (2) (c) GDPR).

Your application is stored for the duration of the closed beta. If no access results from it, we delete it when the beta ends. You can request deletion at any time by writing to contact@scmotif.com.

8. Contact via Email

If you contact us by email, your inquiry and all resulting personal data (name, inquiry) will be stored and processed by us for the purpose of handling your request. We will not share this data without your consent.

The processing of this data is based on Art. 6 (1) (b) GDPR if your inquiry is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of inquiries directed to us (Art. 6 (1) (f) GDPR).

Our mailbox is provided by Google (Google Workspace by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). Google processes your email on our behalf under a data processing agreement (Cloud Data Processing Addendum). Data may be processed by Google LLC in the USA; Google is certified under the EU-US Data Privacy Framework and additionally relies on the EU standard contractual clauses.

We delete your inquiry once it has been dealt with, unless statutory retention obligations apply, such as the six-year retention of business letters under § 257 HGB.

9. Your Rights

You have the right at any time to:

  • Access the personal data we store about you (Art. 15 GDPR)
  • Rectification of inaccurate data (Art. 16 GDPR)
  • Erasure of your data (Art. 17 GDPR)
  • Restriction of processing (Art. 18 GDPR)
  • Data portability (Art. 20 GDPR)
  • Object to processing (Art. 21 GDPR)
  • Withdraw consent you have given, with effect for the future (Art. 7 (3) GDPR)

Right to object under Art. 21 GDPR

Where we process your data on the basis of our legitimate interest (Art. 6 (1) (f) GDPR), you may object to this processing at any time on grounds relating to your particular situation. We will then no longer process your data unless we can demonstrate compelling legitimate grounds that override your interests, or the processing serves the establishment, exercise or defence of legal claims. An informal objection to contact@scmotif.com is sufficient.

If you believe that the processing of your data violates data protection law, you have the right to lodge a complaint with a supervisory authority. The authority responsible for us is the Berlin Commissioner for Data Protection and Freedom of Information (Berliner Beauftragte für Datenschutz und Informationsfreiheit), Alt-Moabit 59-61, 10555 Berlin, Germany.
